There is an important point to be considered if more than one person is working on the development of an idea intended to go to patent, or if someone is contracted or hired to assist in the development of an idea. The US Patent and Trademark office states that anyone involved in the development of the idea is to be named as either the Inventor or Co-inventor.

“Work for hire agreements” address this point and should be put in place when and where appropriate.

Working with others to turn an idea into a reality is probably unavoidable for most inventions. For this reason there should be some ground rules established as well as a hierarchy of decision. If something can go in several directions, and the best direction isn’t obvious, or is subjective, then someone has to make the call so the team can move forward.

Co-inventing might seem obvious as to when it occurs or isn’t occurring, but that’s not completely true. The best defense against anything inappropriate happening to your idea is to put agreements in writing and have the proper forms such as non-disclosures, Work-for-Hire, and payment / ownership rights clearly spelled out and signed by those involved. This can become a very sensitive subject for those that have been hurt by non-specific verbal agreements.
